PIL Case Details

This PIL was registered suo moto , and deals with inter alia, reforms in the State judiciary, specifically relating to appointment of staff in the High Court and subordinate courts. One of the major concerns was the indifferent attitude and in some cases, the turning down of proposals/requests for appointment of staff in the Orissa High Court by the State Government. It was submitted that this had implic ations for the independence of the judiciary in Odisha. On 3 rd March 2021, the AGA clarified that in principle any such request made by the High Court for creation of posts of secretarial and ministerial staff should be accepted by the State Government. Ho wever, where any further examination is felt warranted, some kind of a mechanism which would facilitate a dialogue between the High Court and the Government, should be put in place to examine such request by the High Court before arriving at a final decisi on thereon.
